These Terms of Service ("Terms") govern your access to and use of the ThumbAPI website at thumbapi.dev and the ThumbAPI thumbnail generation API (together, the "Service"), operated by ThumbAPI ("we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account, accessing the API, or using any part of the Service, you confirm that you are at least 16 years old and that you accept these Terms. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.
2. Description of the Service
ThumbAPI provides a REST API for automated thumbnail generation. You send a POST request to our /v1/generate endpoint with a title, format (youtube, instagram, x, or blogpost), and image style (faceless, with-image, or with-logo), and we return a generated thumbnail image. The Service also includes the thumbapi.dev website, documentation, and related tools.
3. API Usage
3.1 API Keys
To use the API, you must register for an account and obtain an API key. Your API key is a secret credential. You are responsible for keeping it secure and must not share it publicly, embed it in client-side code, or commit it to public repositories.
If you believe your API key has been compromised, you must revoke it immediately through your dashboard and generate a new one. You are responsible for all API requests made with your key.
3.2 Rate Limits and Usage Quotas
API usage is subject to the rate limits and monthly generation quotas defined by your subscription plan. If you exceed your plan's limits, additional requests will be rejected with a 429 status code until your quota resets or you upgrade your plan.
We reserve the right to throttle or temporarily suspend access to the API to protect the stability of the Service, even if you have not exceeded your plan's stated limits.
3.3 Acceptable Use
You agree not to use the Service to:
- Generate thumbnails containing illegal content
- Generate thumbnails that infringe on third-party intellectual property rights
- Generate thumbnails depicting minors in any inappropriate context
- Distribute malware or engage in phishing via generated images
- Attempt to reverse-engineer, decompile, or extract the models or algorithms underlying the Service
- Interfere with or disrupt the Service, including through automated abuse or denial-of-service attacks
- Resell access to the API without our written consent
- Use the API in a way that violates any applicable law or regulation
We reserve the right to suspend or terminate your account without notice if we determine, in our sole discretion, that you have violated these usage restrictions.
4. Accounts
You must provide accurate and complete information when creating your account and keep it up to date. You are responsible for maintaining the security of your account credentials. We are not liable for any loss or damage resulting from unauthorized use of your account.
You may delete your account at any time through your dashboard. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.
5. Billing and Payments
5.1 Subscription Plans
ThumbAPI offers free and paid subscription plans. Paid plans are billed monthly or annually, as selected during checkout. Prices are listed on our pricing page and may change with 30 days' notice.
5.2 Payment Processing
Payments are processed by Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You are responsible for ensuring your payment information is current.
5.3 Refunds
We offer a 14-day money-back guarantee for first-time paid subscribers. After the initial 14 days, payments are non-refundable. Unused generations within a billing period do not carry over to the next period and are not refundable.
5.4 Cancellation
You may cancel your paid subscription at any time through your dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to your plan's features until then.
6. Content and Intellectual Property
6.1 Your Content
You retain all rights to the content you submit to the Service, including titles, images, and logos you provide in API requests. You grant us a limited, non-exclusive license to process this content solely for the purpose of generating your thumbnail.
6.2 Generated Thumbnails
Thumbnails generated by the Service are yours to use. We grant you a perpetual, worldwide, non-exclusive license to use, modify, and distribute thumbnails generated through your account for any lawful purpose. We do not claim ownership of generated thumbnails.
However, we do not guarantee that generated thumbnails are unique. Other users submitting similar inputs may receive visually similar outputs. We are not responsible for any similarity between thumbnails generated for different users.
6.3 Our Intellectual Property
The Service, including the API, website, documentation, underlying models, algorithms, and branding, is owned by ThumbAPI and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without written permission.
7. Limitations of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
- We do not warrant that generated thumbnails will be suitable for any particular purpose, will not infringe third-party rights, or will achieve any specific level of engagement or performance.
- In no event shall our total aggregate liability to you exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, regardless of the theory of liability.
8. Indemnification
You agree to indemnify and hold harmless ThumbAPI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms or our Acceptable Use policy
- Non-payment for paid plans
- Extended inactivity (accounts with no API requests for 12 consecutive months)
- Legal or regulatory requirements
- Discontinuation of the Service
Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export your data before termination, except where prohibited by law or where termination is due to abuse.
10. Service Availability and Modifications
We strive to maintain high availability but do not guarantee any specific uptime percentage. We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to provide advance notice of material changes, such as API endpoint deprecations, through our documentation or email.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we will notify you by email or by a prominent notice on the website. Your continued use of the Service after updated Terms take effect constitutes your acceptance of the changes.
